1Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Mufflova, a brand of The Nelson M Group LLC ("Mufflova," "we," "us"). They govern your use of mufflova.com and related services, including email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. Anyone who does not agree to these Terms must stop using the Services.

2What Mufflova is, and is not

Mufflova is an information service. We publish general, plain-language information about how insurance works, how to read a policy, and what tends to affect insurance costs, and let visitors opt in to related updates. We will not sell insurance, give quotes, rates, or price estimates, match people with agents or insurers, or refer people to providers, and we do not share your details with agents, insurers, or any other business partners.

• Decisions about your insurance are yours. Reading our content does not obligate you to do anything.
• Your own insurer or agent, not Mufflova, explains the terms, limits, exclusions, and costs of any policy, and is responsible for your coverage.
• Costs, coverage, and savings vary by person, plan, and location. We will not guarantee that you will save any amount, qualify for any coverage or discount, or get any particular result.

3Eligibility

You must be at least 18 years old, located in the United States, and able to form a binding contract to use the Services. You may only submit information about yourself, or about another person who has authorized you to do so.

4Your information and accuracy

The information you give us must be accurate and current, and you agree to correct it when it changes. Provide only a mobile number that belongs to you or that you are authorized to use. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

5Communications and text-message consent

When you opt in, you agree that email and, if you check the relevant boxes, automated text messages may be used to contact you as described in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. 6Text messaging: rates, frequency, STOP and HELP

• STOP: Reply STOP to any message to opt out (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will get one confirmation text and then no more messages.
• HELP: Reply HELP to any message for help, or contact us by email at [email protected] or by phone at 877-289-1643.

Mobile information and opt-in data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy and SMS Terms.

7Acceptable use

The following are prohibited: (a) submitting false or misleading details, or information about someone else without authority; (b) unlawful, fraudulent, or abusive use of the Services; (c) disrupting the Services or attempting unauthorized access; (d) using bots or automation to submit forms; (e) copying, scraping, or reselling our content without permission; and (f) impersonating a person or entity. Breaking these rules may lead us to suspend or end your access.

8Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (for instance state insurance departments, consumer groups, or insurers) are operated by third parties. We do not endorse any product, plan, or provider, and we are not responsible for what those third parties do, publish, or deliver. Your relationship with an insurer or agent is between you and them.

9Intellectual property

The Services, including the Mufflova name, logo, text, graphics, and design, are owned by us or our licensors and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the Services for personal, non-commercial uses. Photographs on the Site are used under their respective free-use licenses.

10Disclaimers

Services and content are delivered "as is" and "as available," and we disclaim every express or implied warranty, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Uninterrupted, error-free, or secure service is not warranted, and neither is the delivery or timeliness of any message.

Mufflova does not provide insurance, legal, or financial advice, and makes no representation about any policy, coverage, price, savings amount, or claim outcome.

11Limitation of liability

As far as the law allows, Mufflova and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, or goodwill, that arise from your use of (or inability to use) the services or from a insurance decision you make or do not make, and our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

Because some jurisdictions restrict certain limitations, portions of the above may not apply to you. Nothing here limits liability that cannot lawfully be limited.

12Indemnification

You shall indemnify and hold harmless The Nelson M Group LLC and its affiliates and personnel from all claims, damages, and expenses (including appropriate attorneys' fees) arising from violating these Terms, misusing the Services, or providing a phone number or other information without authorization.

13Disputes, governing law, and arbitration

Informal resolution first. Start by writing to us at [email protected] and give us a 30-day window to try to settle it.

Binding arbitration. Excluding small-claims matters and claims for injunctive relief for intellectual-property misuse, any dispute between you and Mufflova or The Nelson M Group LLC about these Terms or the Services is to be resolved by final and binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules. You may elect to hold it in your county of residence or by video or phone. The arbitrator may grant individual relief equal to what a court could, and judgment might be entered in any court of competent jurisdiction.

Class-action waiver. To the extent permitted by law, you and Mufflova each agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, collective, or representative action.

Opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected] with the subject "Arbitration Opt-Out", stating your name and mobile number.

Governing law. These Terms are governed by the laws of the state in which The Nelson M Group LLC has its principal place of business, without regard to conflict-of-law rules, and the Federal Arbitration Act. Subject to the arbitration clause, the state and federal courts located in that state have exclusive jurisdiction.

14Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. We reserve the right to suspend or terminate access at our discretion, including for violations of these Terms. Disclaimers, limitation of liability, indemnification, disputes, and any other section that by its nature should survive will survive termination.

15Changes

We may update these Terms. We will post the new version with a new "Last updated" date. If you continue to use the Services after the effective date, you accept the updated Terms. For material changes, we will provide notification as needed by law.

16General

The entire agreement between you and us on this subject consists of these Terms, the Privacy Policy, and the SMS Terms. Should any part be found unenforceable, the rest continues in effect, and a failure by us to enforce a provision is not a waiver. Assignment by you requires our consent; we may assign these Terms in a merger or sale of the business.
